Penalty for Non-Compliance: What Happens If Your Factory Fails a Safety Audit in India

By Super Admin ·

Nobody Wants to Read This Article — But Everyone Needs To

Let us be honest: reading about penalties is about as enjoyable as reading terms and conditions on your phone's latest update. But fear of consequences drives action faster than knowledge of benefits. You might bookmark our compliance guides "for later." But when you learn that the factory inspector can fine you ₹2 lakh tomorrow for missing safety signs, "later" suddenly becomes "right now."

The OSH Code 2020 Penalty Structure

General Duty Violation (Section 88)

  • First offence: Fine up to ₹2,00,000
  • Continuing offence: Additional ₹3,000 per day

If an inspector issues a notice about missing fire exit signs on March 1st and you have not fixed it by March 31st, that is ₹2,00,000 + (30 × ₹3,000) = ₹2,90,000. For signs that would have cost ₹5,000.

Causing Death Due to Non-Compliance (Section 89)

  • Imprisonment up to 2 years and/or fine up to ₹5,00,000
  • Repeat offence within 5 years: Imprisonment up to 3 years and/or fine up to ₹10,00,000

Beyond Fines: The Hidden Costs

1. Factory Closure Orders

Under OSH Code Section 36, the inspector can order immediate prohibition of work. Daily revenue loss for a medium manufacturing unit: ₹5-15 lakh. One week of closure costs more than a lifetime of safety signs.

2. Insurance Claim Rejections

Factory insurance policies include clauses requiring regulatory compliance. Non-compliant signage gives the insurer grounds to reject your claim. We have heard of ₹50 lakh claims rejected because factories lacked basic fire safety signage.

3. Client Contract Termination

If you are a Tier 1 or Tier 2 supplier to an MNC, a failed safety audit can result in loss of the supply contract.

4. Criminal Record

Penalties for serious violations include imprisonment. A criminal record for the factory occupier or manager has lifelong personal consequences.

What Inspectors Check First

  1. Emergency exit signs — photoluminescent?
  2. Fire extinguisher location signs
  3. PPE mandatory signs at zone entry points
  4. Electrical hazard signs on panels
  5. First aid box location signs

The Simplest Risk/Reward Calculation

ItemCost
Complete factory signage (200-worker factory)₹15,000 – ₹40,000
First offence fineUp to ₹2,00,000
Continuing violation (30 days)₹90,000 additional
One week factory closure₹5,00,000 – ₹15,00,000
Insurance claim rejection₹10,00,000 – ₹1,00,00,000+

The safety signage investment is less than 1% of the potential downside. There is no business justification for delaying compliance.
